Trademarks

The trade marks listed on this page are claimed by Applied AI Pty Ltd (ABN 90 668 168 830, ACN 668 168 830), trading as Insitive, of Melbourne, Victoria, Australia ("Insitive", "we", "our"). BUILDHQ® is a registered Australian trade mark of Applied AI Pty Ltd (IP Australia trade mark no. 2399508), and we use the ® symbol with that mark. We assert rights in the other marks listed on this page as unregistered (common-law) trade marks arising from their use in trade in Australia, and we use the ™ symbol with those marks accordingly.

Unauthorised use of the registered BUILDHQ® mark — or of a substantially identical or deceptively similar mark — in relation to the goods and services for which it is registered may constitute trade mark infringement under the Trade Marks Act 1995 (Cth).

Unauthorised use of the common-law marks — or of any confusingly similar mark — in connection with property-intelligence, valuation, house-siting, livability rating or related software and data services may constitute passing off and a contravention of the Australian Consumer Law (misleading or deceptive conduct), and we reserve all rights and remedies in respect of such use.

INSITIVE™ is the name of our company brand and of the Insitive property-intelligence platform. The mark covers software and data services for property analysis in Australia, including address and cadastral lookup, planning and building-envelope analysis, floor-plan dimension extraction, market data, valuation tools, AI-assisted property consultation, and the developer API through which these capabilities are delivered to other businesses.

The INSITIVE™ name, logo and associated brand elements (including the "BY INSITIVE" accent used with our product marks) are forms of the mark.

INSITIVE LIVABILITY RATING™ (and its acronym ILR™) is our star-rated livability rating product: a deterministic, versioned 0–10 star rating of how well a specific home design lives on a specific lot — covering solar orientation, indoor-outdoor transitions permitted by the setbacks, and the fit between floor levels and the land's natural fall.

The following are all claimed as forms of the mark:

• INSITIVE LIVABILITY RATING™ — the full product name;
• ILR™ — the acronym;
• PILR™ — the preliminary form of the rating (a contours-based preliminary Insitive Livability Rating, shown with silver stars, which upgrades to a gold-star ILR once surveyed or LiDAR floor levels support the rating);
• the star-rating device / badge — the visual star-band rendering of the rating as displayed by Insitive.

VALIDATE™ is our valuation platform for licensed valuers. Validate ingests subject and sale property data from an address lookup or a map click, propagates that data through report and analysis sections, and is API-connected to the Insitive platform. Where available, Validate looks up the PILR/ILR for the property, and it supplies floor plans and survey data that are ingested by Insitive as source data.

The mark covers valuation report-writing software, modular valuation engines, and related data services delivered under the Validate name.

BUILDR™ is our house siting engine, delivered to residential builders as two products:

• The floorplan embed: an iframe/embed (or equivalent) that displays the builder's floor plans on the marketing pages of the builder's own website, with the Insitive Livability Rating (ILR™) surfaced alongside each plan; and
• The consultant tool: a tool for the builder's new-home consultants that does the same and, in addition, guides the consultant and their client to other house plans offered by that builder by surfacing the ILR and the rationale behind it.

The mark covers house-siting software, lot-and-home overlay analysis, setback/envelope verdicts and the associated embed and consultant tooling delivered under the Buildr name.

BUILDHQ® is a registered trade mark of Applied AI Pty Ltd (Australian trade mark registration no. 2399508, registered 3 June 2024 with IP Australia). The mark covers the BuildHQ product and brand — property-technology software and data services for residential builders, including house siting, lot-and-home analysis and related tooling delivered under the BuildHQ name.

Because BUILDHQ® is registered, use of a substantially identical or deceptively similar mark in relation to the registered goods and services may infringe the registration under the Trade Marks Act 1995 (Cth), in addition to any passing-off or Australian Consumer Law claims.

These guidelines apply to builders using the Buildr™ floorplan embed on their own websites and to consultants using the Buildr™ consultant tool, and govern how the ILR™ and BUILDR™ marks may be displayed:

• Display as rendered by Insitive: the marks — including the ILR star-rating badge — must be displayed exactly as rendered by Insitive through the embed or the consultant tool. Do not recreate, redraw or imitate them.
• No alteration or recolouring: the rating badge must not be altered, recoloured, distorted, animated, cropped or combined with other marks. Silver (PILR) and gold (ILR) star treatments must not be swapped or modified.
• No implied endorsement: use of the marks must not suggest that Insitive endorses, certifies or warrants the builder's homes, workmanship or business beyond the rating itself. The rating speaks only to the plan-on-lot pairing it was issued for.
• Attribution: wherever an ILR or PILR is displayed, it must carry the attribution line supplied with the embed or tool (for example "Insitive Livability Rating™ by Insitive"), unmodified and legible.
• No use in product names or domains: licensees must not use INSITIVE, ILR, INSITIVE LIVABILITY RATING, PILR, VALIDATE, BUILDR, BUILDHQ, or any confusingly similar term, in their own product names, service names, company names, domain names, subdomains, social-media handles or app names.
• Revocation: permission to display the marks is limited to the term of the applicable licence and ends when the licence ends or when we reasonably request removal of a non-conforming use.
